This meeting will be held virtually and in-person at the Council Chambers located on 2415 University Ave, First Floor East Palo Alto, CA 94303. The virtual portion of this City Council meeting will be conducted in accordance with City of East Palo Alto Resolution adopted pursuant to Assembly Bill 361.

The public may participate in the City Council Meeting via Zoom Meeting or by attending in-person in the Council Chambers at 2415 University Ave, First Floor East Palo Alto, CA 94303. Community members may provide comments by emailing cityclerk@cityofepa.org, submitting a speaker card at the meeting, or using the RAISE HAND feature when the Mayor or City Clerk call for public comment. Emailed comments should include the specific agenda item on which you are commenting.

3.1

Pre-Qualified list of consulting firms for Engineering on-call services

 

Recommendation:

Approve the list of pre-qualified list of engineering consulting firms for on-call general engineering services to augment City staff with the design and management of engineering services and projects

3.2

Award the Annual Street Resurfacing Project 2024/2025 (ST-07-24) to Goodfellow Bros, California, LLC

 

Recommendation:

Adopt a resolution authorizing the City Manager to award, negotiate, and execute a construction contract with Goodfellow Bros, California, LLC in a form approved by the City Attorney, for $5,249,142.20; establish a fifteen percent (10%) construction contingency in the amount of $524,914.22, for a total construction budget of $5,774,056.42, and execute future change orders in an amount not-to-exceed the appropriated construction contingency.

3.3

Extension of Lease Agreement for Parking at the Tanklage Site

 

Recommendation:

Adopt a resolution approving an eight-month agreement extension from February 12, 2025 to September 12, 2024; the extension will be negotiated by and authorizing the City Manager to continue use of the Tanklage Site for parking, staging and construction offices for the 965 Weeks affordable housing project;

Accept Incentive Award From Peninsula Clean Energy For the Installation of 7 Heat Pump Water Heaters in City Buildings 

 

Recommendation:

Adopt a resolution authorizing the City Manager to enter into an incentive agreement with Peninsula Clean Energy Authority to award the City of East Palo Alto $21,700 in gap funding for the installation of 7 heat pump water heaters in the following City facilities: Community Development Building (1960 Tate Street), Corporation Yard (150 Tara Road), Senior Center (560 Bell Street), and the Re-Entry Center (2277 University Avenue). 

3.5

Temporary Traffic Circle Installation at Fordham Street and Notre Dame Avenue

 

Recommendation:

Adopt a resolution authorizing the installation of a temporary traffic circle and temporary crosswalk at Fordham Street and Notre Dame Avenue.

Recommendation:

Adopt the October 1, 2024, City Council Meeting Minutes.

3.7

Proclamation of the City of East Palo Alto Declaring October Domestic Violence Awareness Month

Consent to Joint Representation

 

Recommendation:

Adopt a resolution authorizing the City Attorney to execute a consent letter agreeing to the joint representation by Goldfarb & Lipman LLP of City of East Palo Alto and Community Housing Developers, Inc., regarding Courtyard at Bay Road.

Authorization to Renew Agreement with Ken Brown Strategic Consulting

 

Recommendation:

Adopt a resolution: 

  1. Authorizing the City Manager to negotiate and execute a retainer agreement with Ken Brown Strategic Consulting, in a form approved by the City Attorney, for an amount not-to-exceed $165,000.
  2. Waiving the formal bid procedures under section 2.84.070(D) of the Municipal Code

Recommendation:

8.1

Conforming rezoning / Zoning Map Amendment (ZC24-001) of a 2.12-acre portion of an existing 2.536-acre parcel at 1933 Pulgas Avenue from R-MD-1 Multiple-Family Medium Density Residential Subzone 1 to R-MD-2 Multiple-Family Medium Density Residential Subzone 2 in East Palo Alto, CA 94303. APN 063-492-280

 

Recommendation:

As considered and recommended by the Planning Commission (Attachment 1 – Planning Commission resolution) at a publicly noticed hearing on September 23, 2024, adopt a resolution:

  1. Amending the official City of East Palo Alto Zoning Map to rezone the subject property from R-MD-1 Multiple-Family Medium Density Residential Subzone 1 to R-MD-2 Multiple-Family Medium Density Residential Subzone 2; and
  2. Finding that the Zoning Map Amendment is within the scope of the project covered by the program Environmental Impact Report (EIR) for the Vista 2035 General Plan, and as such no new environmental document would be required; and additionally, any subsequent residential development would likely qualify for a Class 32 Categorical Exemption unless it is shown, by empirical evidence, that said project would result in significant traffic, noise, air quality, or water quality impacts.

8.2

Ordinance Adding Chapter 13.09 to the Municipal Code Establishing Administrative Remedies Procedure for Challenges to Fees, Charges, and Assessments

 

Recommendation:

By motion: 

 

  1. Waive the first reading and introduce an ordinance adding Chapter 13.09 to the East Palo Alto Municipal Code establishing administrative remedies procedure for challenges to fees, charges, and assessments; and 

 

  1. Find that the adoption by the City Council of the ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to Public Resources Code section 21065 (not a project), and CEQA Guidelines Sections 15061(b)(3) (common sense exemption).

POLICY AND ACTION

 

9.1

Loading Zone along Pulgas Avenue in front of the EPACENTER, 1950 Bay Road

 

Recommendation:

Adopt a resolution authorizing the establishment of a loading zone along the east side of Pulgas Avenue starting forty-two feet south of the Bay Road/Pulgas Avenue intersection centerline, continuing sixty feet southerly from 10 A.M. to 6 P.M. Monday to Saturday

 

9.2

Bag & Tag Policy

 

Recommendation:

Adopt a “Bag and Tag” policy for the storage and recovery of personal items that are removed during encampment clean-up and removal activities.
